Carbonate Chronicle (Leadville, Lake County)
February 14, 1880

Mr. William Nuttal, a well-known theatrical and sporting man of this, was arrested last night on a charge of larceny at the instigation of W. J. Glencross, who claimed to have been robbed of one thousand dollars while in one of the boxes of the Grand Central Theatre last night. The particulars of the case are as follows:

Last night Glencross, Nuttall, Franzer, John Wall, Dollie Lathrop, and two or three others were in one of the boxes of the Grand Central Theatre. A few drinks had gone around, and the party were quite hilarious. The subject of racehorces came up, and Glencross offered to be five hundred dollars trhat a horse owned by John Wall was the fastest in Colorado, or words to that effect. Mr. Nuttall owining a horse with a record, accepted the wager. Glencross pulled out two five hundred dollar bills to make good his wager, and Nuttall having only the sum of three dollars on his person, excuxsed himself and went down stairs into the gaming room, where he obtained a loan of five hundred dollars from Reese, the proprietor of one the faro tables. He returned to find Glencross out of the box crying that he had been robbed, and everything in a hubbub. As Nuttall had five hundred in his possession, he was at once arrested. Nuttall demanded Glencross' arrest and both were taken to the city jail. This morning Mr. Nuttall was released on his own recognizance and will have an examination before Judge McDowall this afternoon. It is said by the parties in the box with Glencross that he had his money after Nuttall left the box, and went outside putting it down in one of his vest pockets. The general opinion is that Mr. Nuttall is guiltless.

Change of Management - William Nuttall Again at the Front
The old denizens of this city who remember the palmy days of drama and variety when the camp was "booming," will feel the old time come over them when it is known that "Billy" Nuttall again assumes away over the fortunes of the new building which has been erected upon the site of his former triumphs. All old-timers will recall with pleasure the scenes of early days, when standing room could hardly be obtained at the old Theatre Comique, where Nuttall was also flying to and fro in his shirt sleeves, ubiquitous in his movements, now listening to a complaint here, now finding comfortable accommodations for a private party there, and the next instant quelling the outburst of some enthusiastic individual whom the light air had exhillarated to a boisterous degree, and above all presiding in such a manner that peace and good will prevailed thoughout the general hilarity. Now he returns agin and resumes his former sceptre, and could the public have seen him bustling around this morning, marshalling his hosts for the coming onslaught upon the public's amusement tastes, it would be seen at once that something more than common was in the air. The theatre has been leased to him by Thomas Kemp, who inends for the present to devote his time to some important mining interests which require his perosnal care, and will be closed until Thursday evening next, when it will reopened with a perfect glory. Mr. James H. Love, late of the amuseemnt firm of Love & Thall, of California and Denver, will be business manager, and a general change will be made in every department. James Le Clair remains as stage manager, and Messrs. Charles Edmonds, Boyd and Wade, Gus Mills, Prof. O'Reardon, Bobby Gaylor, Erba Roberson, Fannie Garretson, Nola Forrest, Georgie Alma, Blanche Walworth and Julia Aiken are among those who remain. Other judicious selections from local favorites and former employees will be made according to ability and general favor with the public, and doubtless this grandest temple of amusement in the city will remain the prominent place for which its architecture and internal appointments fit it to throughly adorn.

A Well Deserved Success. The "Two Orphans" at the Grand Central. In spite of the severe storm on Sundayt evening, an immense audience congregated to witness the above play, and well were they rewarded, for a better has never been given in the state. Nuttall has succeeded in securing a splendid dramatic company, and has surrounded it with such scenery and sostuming as would do credit to any metropolitan city. Mr. Sullivan never appeared to better advantage, and as "Pierre, the Cripple," surpassed anything he has yet done in the city. He was greeted with continued applause, and as New York audiences have already endorsed his rendition of this difficult chracter, it is not surprising that Leadville should coincide. Chas. Edmonds was a manly handsome chevailler, and James Le Claire was excellent in his rendition of "Jacques." Erba Roberson astonished every one by her impersonation of the blind girl. She was successful throughout. Gus Mills most effectually concealed his identity as "Mother Vroohard" and Mrs. Edmonds, Misses Adale Leonard, and Forrest, and Messrs. Howard, Wade, and the entire cast, proved thoroughly compatent. The scenery was superb from first to last, and the first regular dramatic venture at this house is a deserved success. It is to be given again this evening, and will be continued as long as the public affords proper encouragement.

Sid Sidney C. France, a well known actor on Eastern stages for his peformances in "Dead to the World", a drama written and copyrighted in 1875 by Frank Dumont and "Marked for Life or The Missing Finger", a drama written and copyrighted in 1871 by Frank Dumov, was secured by William Nuttall to appear at the Leadville Grand Central Theatre in 1880.

This deservedly popular actor has arrived in town, and is devoting his personal attention to the rehearsals, scenery, etc., of "Marked for Life." The popular verdict upon this play has been a vaery favorable one, indeed, in point of motion, constume, color, appropriate scenery and effective situation. It is long since the public have had an opportunity of enjoyhing stage views more true to life. In producing tthis drama, Mr. Nuttall will spare no pains. This play has made an instantaneous hit elsewhere, and the same result is anticipated for it here, for it is a very strong and interesting story. It is a play that commends itself to the notice of all classes, not only for its fidelity to nature, but also for the popular manner in which this subject is treated. It is placed before the audiance with realistic scenic affects, forming a series of animated pictures which cannot fail to leave a deep impression on the mind. The surroundings will be faithfully copied even in their details, but without these the chief interest will still centre around the artist, who by his excellent impersonation of the leading character, invests it with a cowance that enlists the attention of the audience from the beginning to the end. This engagements is an expensive experiment for Nuttall, and he has therefore decided that those who desire to witness the result of his outlay, must buy tickets of admission. To this effect he will annunce the free list as actually suspended, and he has further found it necessary to return to the old prices, fifty cents below and one dollar upstairs.

"Marked for Life" at the Grand Central Tonight
At last all is in readiness and this noted sensational drama will be given this evening for the first time. There is not much doubt of it success, for the star has already achieved a reputation elsewhere, which is of many years duration, and Leadville has never been slow to recognize actual merit. As the Tabor Opera house has no company, all stars and combinations are obliged to contract with the Grand Central, and Nuttall is using his utmost endeavors to secure the best talent which is available. Having a stage possessing accommodations far superior to any other, and with a company which embraces all the dramatic talent in the state, together with the liberality of expenditure for which he has always been noted, even from his earliest connection with the camp, there is no reason why this theatre should not become a recognized resoret for the most respectable people. If Nuttall refrains from the vulgarities which have been indulged in by other establishments and continues to provide such entertainments as the "Two Orphans" and "Marked for Life," the amusement goers of this city will hav reason to congratulae themselves.

The army of dead heads will be conspicuous by their absence during Mr. France's sojourn, as he controls the admission solely and will have his own agents at the door. The price will be fifty cents down stairs and one dollar above.

Both Nuttall, the manager, and France, the star, have cause for congratulaton athe continued good gusiness at this theatre. "Marked for Life" will be continued the balance of the week, and on Sunday night next an entire change of bill will be presented. no dead-head audiences are now present to geve the ficticious appearance of good business, which so often deceives both manager and creditor, and as long as fotune smiles thus upon Nuttall, just as pleasant will be the smiles of welcome bestowed upon his ceditors, and just so long will those same creditors smile blandly upon him in grateful return.

France's Success at the Grand Central
Sid. C. France can be counted among the most successful, financially, of any prominent professional who has appeared in Leadville. The play, "Marked for Life," is full of laughable incidents and thrilling antimated tableaux, the latter of which afe the culminations of much interesting proceeding situations and dialogue. The Grand Central is taking in more money now than at any time during its previous existence, except during the runs of the "Black Crook" and "Around the World in Eighty Days," and it is now the nearest approach to a legitimate theatre which this play possesses. Nuttall has concluded to give a matinee on Saturday afternoon, (Christmas) in order to amuse the little ones and those who accompany them, making it in reality a Merry Christmas to all who feel disposed to attend. France's success is so great that he will remain another week, when his new play entitled "Dead to the World," will be reproduced. It is already in native rehearsal.

Christmas Afternoon. It will hard work for Nuttall's company next Saturday. France in "Marked for Life" is to be given twice on that date. The ladies and children will thus have an opportunity to enjoy themselves and witness a moral lesson, and at the same time enjoy many a good laugh at the comic antics of Mr. France's "Skid," Boby Gaylor as the heathen Chinese "Sing Soo," and Wade, as the Crushed Tragedian "Tatters," who will ensure a meryy Christmast to all who attend. France's new drama, "Dead in the World," is being mounted in elegant style and will be gen next Sunday evening.

Pocahontas still continues to draw large and enthusiastic audiences nightly to this opular place of amusement. We doubt if there is any theatre in the eastern country that can present a stronger bill of attractions weekly than the Grand Central and we are proud to note th fact that the amusement loving citizens of Leadville are not slow to appreciate the untiring efforts of Managfer Wm. Nuttall, who deserves the earnest support of all admirers of the thespian art. Pocahontas is undobubtly the greatest burlesque of moder times, written by the lae lamented John Brougham, one of the greatest dramatists of the nineteenth centruy. It contains many of the latest musical hits of the day, which are rendered in a manner far above the plane of mediocrity. Gus Mills in the title role, Chas. Edmonds as Powhalan King of the Tuncaroran, Erba Roberson as John Smith, Thos. Wade as Roli, the Dutchman, and Bobby Gaylor as the School Marm deserve special praise for the creditable manner in which they render their respective parts, Harrigan and Hart, latest New York success. "The second degree of the full moon" union is sung in an artistic manner by the entire company. It is a splendid musical composition and never fails to meet with an enthusiastic encore. A number of moritorious specialities follow the burlesque. Bobby Gaylor and Alice Somors in their laughable specialty continue to take the house by storms. The tudors, John and Amy, for their share of approval, Boyd, Wade and Dick Hughes are strong favorites with the habitues of the Grand Central, in fact, all the members of the company are received in a cordial manner by thge large audiances which assemble nightly at the favored temple of the muses. Tonight the pretty Clineton sisters will make their first appearance.

On next Fridaty evening the Union Veterans will benefit at this theatre. We predict a large house for them. The spectacular pantomime, the "Enchanged Mine," will positively be produced Sunay night in all its gorgeous magnificence. You should not fail to visit the Grand Central this and next week if you wish to witness a splendid performance and enjoy yourself at the same time. We congratulare you, Billy Nuttall, on the success of your management.

Grand Central Theatre. No matter how delicate the undertaking manager Nuttall never fails to bring about a happy consummation, and his judgement enables him to cater satisfactorally to all classes. Last night, the performance was such, that the most exacting devotee of morality and the rigid ordinances of society, could have taken no exceptions whatever. Where upon some occasions the sounds of hillarity have from the auditorium, last night it was expelled by universal assent, and the ladies and gentlemen, who had recalled before at a suggestion to attend the Grand Central theatre, were in the most satisfactory mood. A large number of the friends of the Union Veteran association were present and the receipts will be quite handsome contribution to the treasury.

On Sunday night next the "Enchanted Mine" will be produced for the second time in Leadville and those who remember its brilliant and dazelling effects will not permit it to pass without attending. The bill could not be improved upon at present and everybody is pleased with Manager Nuttalls efforts.

Grand Central Theatre. At no time in the history of the Grand Central theatre has there been witnessed a greater success, and Manager Nuttall has reason to congratulate himself upon the patronage and endorsement that his efforts have received. From his first day as manager of the theatre he has modified the entertainments so as to reder it to all classes, and the judgement that he has always exercised is sufficient testimony of his abilities. Great activity is witnessed behind the scenes at present, and the preparations fo the impending benefit insure its success. It will take place on Friday night, and the legion of friends whom Manager Nuttall has made will crowd the building. At present "Fra Diavolo" is upon the boards and is meeting with good success. The patrons an unqualified satisfaction and is received with much demonstration. The olio bill is not permitted to languish and the most superior artists are coming. Presentation of "Cinderella" Last Evening
Last night, according to promise, was produced for the first time at this leading place of amusemnt, Mr. Gus Mills' spectacular burlesque, entitled "Cinderella," in which Gus appeared in the title role, and it is unnecessary to any that he played his part to perfection. His dress was simply gorgeous. Mr. Edmonds, as the Baron, noted his part in an admirable manner, while Miss Erba Roberson, as the swell, more than did credit to herself. Tommy Wade, as Clorinda, although a new line of business to him, acquitted himself nicely, and kept the audience in a good humor, while the balance of the characters, which were assigned to the balance of the monster stock company, were all up in their lines and rendered in a satisfactory manner. Miss Nellie Dearing was substituted in place of Miss Alice Somers, who is a present lying very ill, and considering the short notice, more than did justice to herself. Manager Nuttall is always alive to business, and this display of energy added another triumphal score in securing the wonderful "Nautch Dancers," who kept the audience in an uproar of laughter with their grotesque dancing, and will no doubt add anohter financial success to the management.

Tonight will occur the annual masquerade ball for the boys and girls, and it promises to be a grand success. At present over fifty of the new costumes which have been procured for this special occasion have been given out. Manager Nuttall wishes to extend all a cordial invitation to attend tongiht, as he will himself, be on the floor to superintend things, which alone is guarantee enogh that everything will be enjoyable, as he never does things by halves.

A Synopis of the Decision of Justice Field in the Placer Pastent Cases
Special Dispatch to the Hearal
Washington, D. C., March 8, Two important Leadville patent cases have been decided in the supreme court, the opinons being by Field. The cases are, the St. Louis Smelting and Refining company, plaintiffs in error, against Kemp and Nuttall.

Justice Field said: "We are of the opinion that the several grounds are well taken, and that in each particular, the court below errod. If the intruders upon these claims could compel the holders of patents in every suit for possession to establish the validity of the action of the land department and the correctness of the ruling, the patent, instead of being a means of security, would subject the right of those patent holders to constant and ruinous litigation. The court below erred in admitting the record of the proceedings upon which the patent issued to impeach its validity and also in confounding the location and 'mining claim'."
